Little is known about research misconduct within industry and how it compares to universities, even though a lot of biomedical research is performed by–or in collaboration with–commercial entities. Therefore, we sent an e-mail invitation to participate in an anonymous computer-based survey to all university researchers having received a biomedical research grant or scholarship from one of the two national academic research funders of Belgium between 2010 and 2014, and to researchers working in large biomedical companies or spin-offs in Belgium. (...) The validated survey included questions about various types of research misconduct committed by respondents themselves and observed among their colleagues in the last three years. Prevalences of misconduct were compared between university and industry respondents using binary logistic regression models, with adjustments for relevant personal characteristics, and with significance being accepted for p < 0.01. The survey was sent to 1766 people within universities and an estimated 255 people from industry. Response rates were 43 and 48%, and usable information was available for 617 and 100 respondents, respectively. In general, research misconduct was less likely to be reported by industry respondents compared to university respondents. Significant differences were apparent for one admitted action and three observed actions, always with lower prevalences for industry compared to universities, except for plagiarism. This survey, based on anonymous self-report, shows that research misconduct occurs to a substantial degree among biomedical researchers from both industry and universities. (shrink)

We develop an extension of the familiar linear mixed logit model to allow for the direct estimation of parametric non-linear functions defined over structural parameters. Classic applications include the estimation of coefficients of utility functions to characterize risk attitudes and discounting functions to characterize impatience. There are several unexpected benefits of this extension, apart from the ability to directly estimate structural parameters of theoretical interest.

We propose a method for estimating subjective beliefs, viewed as a subjective probability distribution. The key insight is to characterize beliefs as a parameter to be estimated from observed choices in a well-defined experimental task and to estimate that parameter as a random coefficient. The experimental task consists of a series of standard lottery choices in which the subject is assumed to use conventional risk attitudes to select one lottery or the other and then a series of betting choices in (...) which the subject is presented with a range of bookies offering odds on the outcome of some event that the subject has a belief over. Knowledge of the risk attitudes of subjects conditions the inferences about subjective beliefs. Maximum simulated likelihood methods are used to estimate a structural model in which subjects employ subjective beliefs to make bets. We present evidence that some subjective probabilities are indeed best characterized as probability distributions with non-zero variance. (shrink)

Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. We (...) conclude that difficulties in holding “electronic persons” accountable when they violate the rights of others outweigh the highly precarious moral interests that AI legal personhood might protect. This book makes a novel contribution to our understanding of Romance SE constructions by combining both diachronic and synchronic theoretical perspectives along with a range of empirical data from different languages and dialects. The collection, divided into four sections, proposes that SE constructions may be divided into one class that is the result of grammaticalization of a reflexive pronoun up the syntactic tree, from Voice and above, and another class that has resulted from the reanalysis of reflexive and anticausative morphemes (...) as an argument expletive or verbal morpheme generated in positions from Voice and below. The contributions, while varied in both empirical content and theoretical approach, all serve to highlight different aspects of the overarching idea that SE constructions have evolved from these two distinct grammaticalization paths. The book appeals to researchers and academics in the field and closes with a unified approach to various SE constructions that makes important use of its status as a verbal morpheme. In addition to aligning a novel string of empirical contributions under a new theoretical umbrella, a clear research direction emerges from this volume based on the morphosyntactic nature of SE itself: Is it a clitic, an agreement morpheme, or a verbal morpheme? Connecting human minds to various technological devices and applications through brain-computer interfaces (BCIs) affords intriguingly novel ways for humans to engage and interact with the world. Not only do BCIs play an important role in restorative medicine, they are also increasingly used outside of medical or therapeutic contexts (e.g., gaming or mental state monitoring). A striking peculiarity of BCI technology is that the kind of actions it enables seems to differ from paradigmatic human actions, because, effects in the world are (...) brought about by devices such as robotic arms, prosthesis, or other machines, and their execution runs through a computer directed by brain signals. In contrast to usual forms of action, the sequence does not need to involve bodily or muscle movements at all. A motionless body, the epitome of inaction, might be acting. How do theories of action relate to such BCI-mediated forms of changing the world? We wish to explore this question through the lenses of three perspectives on agency: subjective experience of agency, philosophical action theory, and legal concepts of action. Our analysis pursues three aims: First, we shall discuss whether and which BCI-mediated events qualify as actions, according to the main concepts of action in philosophy and law. Secondly, en passant, we wish to highlight the ten most interesting novelties or peculiarities of BCI-mediated movements. Thirdly, we seek to explore whether these novel forms of movement may have consequences for concepts of agency. More concretely, we think that convincing assessments of BCI-movements require more fine-grained accounts of agency and a distinction between various forms of control during movements. In addition, we show that the disembodied nature of BCI-mediated events causes troubles for the standard legal account of actions as bodily movements. In an exchange with views from philosophy, we wish to propose that the law ought to reform its concept of action to include some, but not all, BCI-mediated events and sketch some of the wider implications this may have, especially for the venerable legal idea of the right to freedom of thought. In this regard, BCIs are an example of the way in which technological access to yet largely sealed-off domains of the person may necessitate adjusting normative boundaries between the personal and the social sphere. Pharmacogenetics and disease genetics studies are becoming increasingly prevalent, leading to a growing body of information on genetic associations for drug responsiveness and disease susceptibility with the potential to improve health care. Much of these data are presently characterized as exploratory (non‐validated or hypothesis‐generating). There is, however, a trend for research participants to be permitted (...) access to their personal data if they so choose. Researchers, sponsors, patient advocacy groups, ethics committees and regulatory authorities are consequently confronting the issue of whether, and how, study participants might receive their individual results. Noted international ethico‐legal guidelines and public policy positions in Europe and the United States are reviewed for background. The authors offer ‘Points‐to‐Consider’ regarding returning research results in the context of drug development trials based on their knowledge and experience. These considerations include: the clinical relevance of data, laboratory qualifications, informed consent procedures, confidentiality of medical information and the competency of persons providing results to participants. The discussion is framed as a benefit‐to‐risk assessment to balance the potential positive versus negative consequences to participants, while maintaining the integrity and feasibility of conducting genetic research studies. In this paper an analysis of Newton’s argument for universal gravitation is provided. In the past, the complexity of the argument has not been fully appreciated. Recent authors like George E. Smith and William L. Harper have done a far better job. Nevertheless, a thorough account of the argument is still lacking. Both authors seem to stress the importance of only one methodological component. Smith stresses the procedure of approximative deductions backed-up by the laws of motion. Harper stresses “systematic dependencies” (...) between theoretical parameters and phenomena. I will argue that Newton used a variety of different inferential strategies: causal parsimony considerations, deductions, demonstrative inductions, abductions and thought-experiments. Chaque fois que notre vie rencontre un obstacle, nous sommes invités à nous déprendre de nous-mêmes. Ce consentement à la mort (...) se nomme amour. Mourir à soi-même, c'est tuer ce qui, dans notre vie, est obsédé par la vie. Ces "petites morts", lues à partir de la pensée de Simone Weil, indiquent un chemin de dépossession et de plénitude. A l'heure où nous serons dessaisis de tout, c'est notre propre vie qui nous sera redonnée. Nous étions à la lisière du paradis, et nous ne le savions pas! O artigo pretende discutir as representações sobre a derrota da Seleção Brasileira para a Alemanha na semifinal da Copa do Mundo de 2014 em matéria publicada pelo jornal Zero Hora. Para tanto, recupera-se o contexto histórico e a perspectiva dos Estudos Culturais para a problematização das relações entre sociedade, cultura e meios de comunicação, com destaque para o conceito de representação, central para a compreensão dos processos de produção de sentidos postos em circulação no meio social. O percurso teórico está (...) ancorado nas estruturas de sentimento, propostas por Raymond Williams, um dos precursores dos Estudos Culturais. A análise de discurso é utilizada como técnica para identificação dos sentidos, mapeando as formações discursivas presentes no discurso jornalístico. Este trabalho traz como resultado as relações e tensões entre os sentidos presentes no discurso jornalístico e as estruturas de sentimento vigentes na sociedade. (shrink)

Currently, electronic agents are being designed and implemented that, unprecedentedly, will be capable of performing legally binding actions. These advances necessitate a thorough treatment of their legal consequences. In our paper, we first demonstrate that electronic agents behave structurally similar to human agents. Then we study how declarations of intention stated by an electronic agent are related to ordinary declarations of intention given by natural persons or legal entities, and also how the actions of electronic agents in this respect have (...) to be classified under German law. We discuss four different approaches of classifying agent declarations. As one of these, we propose the concept of an electronic person (i.e., agents with limited liability), enrolment of agents into an agent register, and agent liability funds as means to serve the needs of all contracting parties. Wissen, so lautet die unausgesprochene Maxime der Humanisten und Polyhistoren der Frühen Neuzeit, kann man nie genug erwerben. Riesige Bibliotheken und Kunstkammern sowie voluminöse Abhandlungen, Geschichtswerke und Enzyklopädien geben noch heute eindrucksvoll Rechenschaft von dieser Leidenschaft. Doch wächst mit der Größe jeder Sammlung auch die Notwendigkeit ihrer Ordnung. Es ist daher kein Zufall, dass ›Ordnung‹ zum Schlüsselbegriff des humanistischen Enzyklopädismus aufgestiegen und zum Gegenstand hartnäckiger Auseinandersetzungen unter den Gelehrten geworden ist. In Steffen Siegels Untersuchung werden die vielfältigen philosophischen Versuche, (...) die Fülle des Wissens systematisch zu ordnen, nicht allein anhand der Überlieferung von Texten rekonstruiert. Im Zentrum dieser reich illustrierten Studie, die bei mittelalterlichen Wissenspraktiken ihren Ausgang nimmt, sich insbesondere den vielschichtigen Bildkulturen des 16. und 17. Jahrhunderts widmet und einen Ausblick auf moderne Visualisierungstechniken bietet, steht die faszinierende Vielfalt jener Bilder, die Ordnungen des Wissens als sichtbare Figuren vor Augen rückten. Die Bedeutung von Schautafeln und Bildallegorien, von wissenschaftlichen Illustrationen und Karten wird, mit Blick auf die Frage nach möglichen Ordnungen des Wissens, in diesem Buch zum ersten Mal übergreifend analysiert. Ein Akzent der Untersuchungen liegt auf der bislang nur wenig erforschten Geschichte des Diagramms in der Frühen Neuzeit. In der Mitte zwischen den Darstellungsmöglichkeiten von Bildern und Texten, standen insbesondere diagrammatische Schemata im Dienst der Konstruktion und der Beglaubigung von Ordnungen des Wissens. Anhand der reichen Tradition frühneuzeitlicher Diagramme lassen sich in hervorragender Weise die Potentiale, aber auch die Probleme eines Zusammenspiels von Wissens-, Ideen- und Mediengeschichte in der Zeit um 1600 ablesen und profilieren. Mit den im Jahr 1587 in Paris publizierten Tableaux legte Montaignes Zeitgenosse Christophe de Savigny eines der erstaunlichsten und reichsten Zeugnisse frühneuzeitlicher Kunst im Dienst einer solchen Wissensgeschichte vor. Das Tafelwerk steht daher im Mittelpunkt der Untersuchungen zu den Figuren enzyklopädischer Wissensordnungen. Erstmals seit seiner Publikation vor über fünfhundert Jahren wird dieses sehr selten gewordene, für die Gelehrtenkultur des 16. Jahrhunderts äußerst repräsentative Werk hier vollständig und in einer farbigen Reproduktion wieder zum Druck gebracht. Die komplexen Strategien, mit Hilfe von Bildern, Diagrammen und Texten für eine bestimmte Wissensordnung zu argumentieren, lassen sich auf diese Weise an einer bedeutenden Quelle der vormodernen Gelehrtengeschichte minutiös nachvollziehen. Die Fülle des Wissens und die Möglichkeiten seiner Ordnung werden dabei als Herausforderungen sichtbar, die in gleicher Weise das Interesse der Kunstgeschichte und der Kulturwissenschaft, der Wissenschafts- und Pädagogikgeschichte und der Philosophie berühren. In this paper we study an alternative approach to the concept of abstract logic and to connectives in abstract logics. The notion of abstract logic was introduced by Brown and Suszko —nevertheless, similar concepts have been investigated by various authors. Considering abstract logics as intersection structures we extend several notions to their κ -versions, introduce a hierarchy of κ -prime theories, which is important for our treatment of infinite connectives, and study different concepts of κ -compactness. We are particularly interested (...) in non-topped intersection structures viewed as semi-lattices with a minimal meet-dense subset, i.e., with a minimal generator set. We study a chain condition which is sufficient for a minimal generator set, implies compactness of the logic, and in regular logics is equivalent to compactness of the consequence relation together with the existence of a inconsistent set, where κ is the cofinality of the cardinality of the logic. Some of these results are known in a similar form in the context of closure spaces, we give extensions to intersection structures and to big cardinals presenting new proofs based on set-theoretical tools. The existence of a minimal generator set is crucial for our way to define connectives. Although our method can be extended to further non-classical connectives we concentrate here on intuitionistic and infinite ones. Our approach leads us to the concept of the set of complete theories which is stable under all considered connectives and gives rise to the definition of the topological space of the logic. Topological representations of abstract logics by means of this space remain to be further investigated. (shrink)

The Chomskian holds that the grammars that linguists produce are about human psycholinguistic structures, i.e. our mastery of a grammar, our linguistic competence. But if we encountered Martians whose psycholinguistic processes differed from ours, but who nevertheless produced sentences that are extensionally equivalent to the set of sentences in our English and shared our judgements on the grammaticality of various English sentences, then we would count them as being competent in English. A grammar of English is about what the Martians (...) and we share. In this note, I argue that a recent attack on the Martian Argument by Laurence fail to mitigate its force. (shrink)

Menschen können missachtet werden. Woher aber rührt diese symbolische Verletz-barkeit? Und welche Folgen hat sie für unser soziales Zusammenleben? Im Ausgangvon den Theorien der Anerkennung und den Theorien der Alterität geht Steffen Herrmann diesen beiden Fragen nach. Er argumentiert im Anschluss an G.W.F. Hegel dafür, dass eine asymmetrische Abhängigkeit von der Anerkennung von Anderendie Ursache von symbolischer Verletzbarkeit bildet. Sodann zeigt er im Anschluss an E. Levinas, dass die Folge dieser Verletzungsoffenheit eine asymmetrische Ausge-setztheit an die Verantwortung für Andere (...) ist. Aus den Arbeiten von Hegel und Levinas wird so die Grundthese der vorliegenden Untersuchung gewonnen: Die Begegnung zwischen Ich und Anderem ist strukturiert durch die doppelte Asymmetrie des Sozialen. We examine the sequences A that are low for dimension, i.e. those for which the effective dimension relative to A is the same as the unrelativized effective dimension. Lowness for dimension is a weakening of lowness for randomness, a central notion in effective randomness. By considering analogues of characterizations of lowness for randomness, we show that lowness for dimension can be characterized in several ways. It is equivalent to lowishness for randomness, namely, that every Martin-Löf random sequence has effective dimension (...) 1 relative to A, and lowishness for K, namely, that the limit of KA/K is 1. We show that there is a perfect [Formula: see text]-class of low for dimension sequences. Since there are only countably many low for random sequences, many more sequences are low for dimension. Verschwörungserzählungen erleben im Zuge der Corona-Krise eine breite gesellschaftliche Beachtung und Anschlussfähigkeit. Dabei bleibt es nicht bei bloßen Agitationsversuchen seitens ihrer Anhänger:innen, sondern es kam zu Übergriffen auf vermeintlich an der Pandemie Schuldige sowie einer versuchten Stürmung des Reichstagsgebäudes im Kontext einer Querdenken-Demonstration. Von Verschwörungsgläubigen kann also tatsächlich eine konkrete Gefahr für diejenigen ausgehen, die innerhalb der Verschwörungserzählung als das Böse markiert werden. Es stellt sich also die Frage, auf welchem Wege hier bereits präventiv gewirkt werden kann. In seinen Überlegungen (...) zur conspiracy theory of society kam Karl Popper zu dem Schluss, dass es sich bei Karl Marx aufgrund seiner Analyse der Gesellschaft um einen wichtigen Akteur gegen Verschwörungserzählungen handele. Popper begründete dies damit, dass Marx den Fokus auf gesellschaftliche Strukturen als Ursache für konkrete Entwicklungen lege, anstatt diese auf das Handeln von Individuen zurückzuführen. Sofern der Bezug auf das individuelle, geheime Handeln verborgener Personen eine Grundstruktur von Verschwörungserzählungen ist, ließe sich also ableiten, dass politische Akteure, deren Gesellschaftsanalyse sich in einer marxistischen Tradition bewegt, deutlich seltener auf Verschwörungserzählungen zurückgreifen dürften. Die Ergebnisse der Leipziger Autoritarismusstudie 2020 bestätigen diese Überlegung insofern, als der Verschwörungsglaube stark mit menschenverachtenden Einstellungen und rechtsradikalen Positionen korreliert. Gleichzeitig konnte bei den Querdenken-Demonstrationen eine breite Beteiligung von Personen jenseits der radikalen Rechten beobachtet werden, was durch Oliver Nachtwey mit den Worten „von links kommend, nach rechts gehend“ beschrieben wurde. Die mögliche Anschlussfähigkeit von Verschwörungserzählungen auch für Personen aus einem sich selbst als links definierenden Spektrum stellt das immunisierende Potential marxistischer Gesellschaftskritik gegenüber dem Verschwörungsglauben in Frage. Der Aufsatz unternimmt den Versuch, die Vereinbarkeit einer marxistischen Gesellschaftsanalyse mit dem Glauben an Verschwörungserzählungen zu prüfen. Dazu werden grundlegende Strukturen von Verschwörungserzählungen, wie etwa das manichäische Weltbild oder der Glaube an die absolute menschliche Handlungsmacht, mit den Prinzipien Marx’schen Denkens kontrastiert. Hierbei soll geprüft werden, welchen Beitrag eine marxistische Analyse zur Kritik an Verschwörungserzählungen leisten kann. (shrink)
